1. Acceptance of Terms

By creating an account or using the Apex VPN network, website, or mobile application, you agree to be bound by these Terms of Service. These terms govern your access to and use of Apex VPN's software, network, and website. If you do not agree to these terms, you are prohibited from using our services.

2. Provision of Service

Apex VPN provides a virtual private network service designed for privacy and high-speed data transmission. While we aim for maximum uptime, the service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the service at any time. Where possible, we will provide advance notice of significant changes.

3. User Conduct & Prohibited Activities

You agree to use Apex VPN only for lawful purposes. Prohibited activities include, but are not limited to:

• Engaging in any activity that violates local, state, or international laws.
• Using the service to transmit malware, viruses, or harmful code.
• Attempting to gain unauthorized access to our network or third-party systems.
• Engaging in DDoS attacks or activities that disrupt network stability.
• Sharing your account credentials with third parties.
• Using the service for spamming, phishing, or any form of fraudulent activity.

Violation of these terms may result in immediate suspension or termination of your account without refund.

4. Subscription & Payments

Some features of Apex VPN require a paid subscription. All payments are processed through secure third-party gateways. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected plan (monthly or annual) until you cancel. You are responsible for all charges incurred under your account.

5. Cancellation & Refund Policy

You may cancel your subscription at any time through your account settings or by contacting us at info@apexvpn.tech. Upon cancellation, your subscription will remain active until the end of the current billing period, after which it will not renew.

Refunds: We offer a 7-day money-back guarantee for new subscriptions. If you are unsatisfied within 7 days of your initial purchase, contact us for a full refund. Refunds are not issued for subsequent renewal periods or for accounts found in violation of these Terms. For purchases made through Google Play, Google Play's own refund policy also applies.

6. Account Termination & Deletion

You may delete your account at any time by navigating to Settings > Account > Delete Account in the app or website, or by emailing info@apexvpn.tech. Account deletion will permanently remove your personal data from our systems within 30 days. Active subscriptions should be cancelled before requesting deletion to avoid further charges.

We reserve the right to suspend or terminate accounts that violate these Terms of Service, with or without notice.

7. Limitation of Liability

Apex VPN shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the service. We do not guarantee the security of data transmitted over the internet, although we employ industry-standard AES-256 encryption on our network. Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of Switzerland.
